    Obiettivi formativi

    L’insegnamento mira ad individuare il metodo della comparazione e lo sviluppo del Diritto costituzionale comparato, tenendo anche conto della circolazione dei modelli. Pertanto, al termine del percorso di insegnamento lo studente dovrà conoscere gli istituti fondamentali della materia.
    Conoscenza e capacità di comprensione
    Lo studente potrà acquisire un’elevata conoscenza delle categorie giuridiche che sono alla base del Diritto pubblico comparato, stimolando la sua capacità di comprensione.
    Conoscenza e capacità di comprensione applicate
    Lo studente dovrà conoscere e applicare gli istituti giuridici rilevanti, individuando come risolvere problemi giuridici complessi della prassi internazionale e comparata.
    Autonomia di giudizio
    Lo studente dovrà dimostrare di saper gestire la complessità delle materie oggetto del corso, di integrare i dati acquisiti, anche attraverso un accesso autonomo alle fonti normative, alla giurisprudenza e in genere alla prassi degli Stati e dell’UE. Lo studente dovrà sviluppare capacità critiche e analisi personali e esprimere giudizi autonomi.
    Abilità comunicative
    Lo studente dovrà utilizzare in modo appropriato il linguaggio giuridico specialistico, anche in lingua straniera, del diritto internazionale e del diritto dell’UE, e argomentare in modo chiaro, tecnico e convincente.
    Capacità di apprendere
    Lo studente dovrà dimostrare la sua capacità di apprendere in modo autonomo e di spaziare tra categorie e regole giuridiche con padronanza oltre che con metodologie logiche e di apprendimento proprie.

    Metodologie didattiche

    Lezioni frontali per 54 ore, cui si aggiungeranno lavori in gruppo di studio.

    Metodi di valutazione

    Il metodo di valutazione dello studente consisterà in un colloquio orale, attraverso cui si verificherà il suo livello di approfondimento, la capacità di sintesi, quando richiesta, l’uso corretto del lessico specialistico, oltre alla capacità di saper collegare le diverse parti del programma studiato.
    La valutazione in trentesimi terrà conto dell’approfondimento realizzato della materia (di tipo dottrinale, legislativo e giurisprudenziale), della capacità critica del candidato, della abilità a realizzare gli indispensabili collegamenti tra le diverse parti del programma, il tutto supportato da un coerente ragionamento che possa evidenziare una raggiunta maturità. I diversi livelli di preparazione giustificheranno una differente valutazione: eccellente (30 e lode), ottima (28/30), buona (25/27), discreta (21/24), sufficiente (18/20).

    Course objectives

    The teaching aims to identify the comparative method and the development of comparative constitutional law, also taking into account the circulation of models. Therefore, at the end of the teaching, the student shall be familiar with the fundamental institutes of the subject.
    Knowledge and Ability to Understand
    The student shall acquire a high level of knowledge of the legal categories underlying comparative public law, stimulating his or her ability to understand.
    Applied knowledge and understanding
    The student is expected to know and apply the relevant legal institutions, identifying how to solve complex legal problems in international and comparative practice.
    Autonomy of judgement
    The student shall demonstrate the ability to handle the complexity of the subjects covered by the course, to integrate the acquired data, also through autonomous access to regulatory sources, case law and in general to the practice of States and the EU. The student is expected to develop critical skills and personal analysis and to express autonomous judgements.
    Communication skills
    The student will have to use appropriately the specialised legal language, also in foreign languages, of international law and EU law, and to argue in a clear, technical and convincing way.
    Ability to learn
    The student is expected to demonstrate his/her ability to learn independently and to span legal categories and rules with mastery as well as his/her own logical and learning methodologies.

    Teaching methods

    Lectures for 54 hours, to which group work will be added.

    Evaluation methods

    The student's assessment method will consist of an oral interview, through which his or her level of in-depth study, ability to synthesise when required, correct use of specialist vocabulary, as well as the ability to be able to connect the different parts of the programme studied will be verified.
    The evaluation in thirtieths will take into account the in-depth study of the subject (doctrinal, legislative and jurisprudential), the candidate's critical capacity, the ability to make the indispensable connections between the different parts of the syllabus, all supported by coherent reasoning that can highlight an achieved maturity. The different levels of preparation will justify different marks: excellent (30 cum laude), very good (28/30), good (25/27), fair (21/24), sufficient (18/20).
